Termination of employment

Objective

The objective of this policy is to ensure that all employees are aware of obligations in relation to Termination of Employment. This is also to provide employees and Managers with information and guidelines regarding ceasing employment.

Definitions

An employee’s employment will be terminated in any of the following situations:

  • When an employee submits their resignation on notice or retirement.
  • When an employee’s employment ceases for reasons of poor performance or misconduct including breach of Strathfield Sports policies or procedures.
  • When an employee’s fixed term contract expires.
  • When an employee’s role is redundant.
  • Abandonment of employment.
  • Other circumstances which end the employment such as (but not limited to) the death of an employee.

Responsibilities

General Manager

  • Notify Manager/Supervisors of employees’ entitlements upon termination as required.
  • Complete termination paperwork.
  • Liaise with Admin to ensure termination payments are processed.
  • Ensure separation certificates are completed and forwarded to the employee or Centrelink where required.

Manager/Supervisor

  • Notify General Manager of an employee’s intention to cease employment.
  • For casual employees, where required, collect all Strathfield Sports property.
  • Complete termination paperwork.

Employees

  • Advise their Senior Managements in writing of their intention to cease employment including the date effective.
  • Comply with notice provisions as set out in their letter of employment.
  • Complete termination paperwork.
  • Return all Strathfield Sports property.

Guidelines

Full Time and Permanent Part Time employees
  • When a Full Time or Permanent Part Time employee decides to cease employment, it must be in line with the notice period requirements set out in their terms and conditions of employment. The resignation must be submitted in writing or email to General Manager. The employee’s last day of employment should be included in the resignation letter.
  • Upon receipt of the resignation, the General Manager must complete a Termination Appraisal and submit this to Admin with the employee’s resignation.
  • General Manager will advise Manager/Supervisor that the employee will be ceasing employment by sending an e-mail with the employee’s termination details.
  • General Manager will forward Termination paperwork to Payroll for action.
Casual employees
  • Casual employees must advise in writing of their intention to cease work.
  • When a casual employee ceases employment or is no longer available to be rostered, the General Manager must complete the Termination Appraisal.
Termination of Employment
  • The employee should advise Administration of any change to address details.
  • The Manager/Supervisor must collect any Strathfield Sports Property from the employee.
  • General Manager will forward Termination paperwork to Payroll for action.
Redundancy
  • An employee’s role can become redundant where Strathfield Sports no longer requires the employee’s job role to be performed by anyone i.e. due to technological or organisational change.
  • Where an employee is made redundant, resulting in termination of their employment, redundancy payments will be made in accordance with the National Employment Standards (NES) and applicable legislation, including relevant industrial awards.
Retirement

• Employees who are considering retirement should inform their General Manager at the earliest opportunity and in line with the relevant notice period set out in their contract of employment so that Strathfield Sports can determine the appropriate actions required.

Disciplinary Action

• An employee may be terminated from Strathfield Sports on the basis of poor performance, poor behaviour or misconduct.

Final payment
  • Where possible, an employee’s final payment will be processed during their last week of employment. This will include payment for hours worked and any accrued leave that is owing.
  • An employee’s final payment may be withheld if all Strathfield Sports property has not been returned.
Employment Separation Certificate
  • When requested by the employee, either General Manager or Admin will complete an Employment Separation Certificate.
  • This certificate will be provided to the employee or directly to Centrelink.
Changing employment status/resigning from a permanent position
  • When a permanent employee resigns from their permanent position and wishes to continue working on a casual basis, the employee is required to inform their General Manager in writing.
  • The employee’s final payment will be made in accordance with section of this policy.
  • The employee’s previous period of employment/service will only be recognised to the extent required by law.
  • The individual will be issued with a new employee number.
  • In certain circumstances, at the discretion of the General Manager requests for recognition of previous service may be considered.
Re-commencing employment
  • The termination advice and previous employment history will be considered before a decision to re-employ is made. 
  • For the purposes of leave accruals and service recognition, previous periods of employment will not be recognised.
  • When an individual has previously been employed and recommences employment with Strathfield Sports, they will be required to complete new paperwork.
  • The individual will be issued with a new employee number.

Breach of Policy

Strathfield Sports Club has an obligation to consistently apply and enforce this policy. Employee must understand and comply with this policy.

Any employee who breaches this policy shall be subject to counselling, training, and/or disciplinary action, which may include termination of employment.
